Firm involved in re-call of pork is successful in High Court
A MULTI-million euro legal action by the Clohamon based Millstream Recycling company against a Dublin businessman can go ahead, a High Court judge has ruled. The company whose animal feed was at the centre of the dioxin scare late in 2008 is taking legal action against Gerard Tierney (75), Newtown Park Avenue, Blackrock, Co Dublin, as well as his company, Newtown Lodge Ltd,
The Judge rejected Tierney's claim that no case had been made out against him as an individual. He also instructed the Gardaí to hand over the results of some forensic tests.
The gardai are still investigating the causes of the incidents, which prompted a re-call of all Irish pork, is still going on. The Clohamon outfit – which is waiting to deal with outstanding claims to a total of €36 million from former customers - maintains that the problem was caused by defective oil, though liability is denied by the defendants.
