Hammer assault case is adjourned
GARDAÍ in Wexford have until September to prepare a book of evidence in respect of a man charged with assaulting another man with a claw hammer at Ferndale Park.
Patrick Jordan (39), of 18a Ferndale Park, is charged with assaulting David Doyle, causing him harm, at Ferndale Park on January 30 last.
Jordan is further charged with possession of the claw hammer with the intention of injuring or intimidating Mr Doyle and then producing it during the course of a dispute, under the Firearms and Offensive Weapons Act.
Ed King, for Jordan, noted that Judge William Earley had refused jurisdiction in the case earlier this year and it had been adjourned for the preparation of a book of evidence so Jordan could be sent forward to the circuit court.
Last Tuesday, Inspector Pat McDonald told Judge O Buachalla that gardaí need further time to prepare the book of evidence and the case was adjourned until September 5, with Jordan remanded on continuing bail.
However, Judge O Buachalla marked it peremptory against the State, so if the book of evidence isn't ready on that date the case against Jordan may be thrown out.
