Quarry owner's conviction is lifted on appeal
QUARRY operator Jackie Cadogan from Carrowreigh, Taghmon, has had a District Court conviction for failing to comply with a County Council enforcement notice lifted on appeal to Wexford Circuit Court.
The conviction was handed down in February 2010, when a fine of €1,000 and an order for costs of €2,100.68 were handed down. At the appeal last week, County Council solicitor Triona Walsh confirmed the matter related to quarrying, and told the court the Council was not in a position to oppose the appeal as its main witness was on long-term sick leave and therefore unable to come to court.
In the circumstances, Judge Barry Hickson allowed the appeal.
