Road rage complaints withdrawn

TWO YOUNG Wexford men charged with assaulting each other following a road rage incident have withdrawn their complaints against each other.

Damien Carr, 6 Michael J Sinnott Drive, Castlebridge, was charged with assault causing harm to Ben Gavin at Clonard Road on October 8, 2008. Gavin, of 22 Coolcotts Court, Coolcotts Lane, was charged with assault causing harm to Carr arising out of the same incident.

Evidence in the case had been heard earlier this year when Gavin told how he had to get his jaw wired and needed veneers on his teeth after an assault by Carr. Carr in turn alleged that he was first head butted by Gavin which resulted in him hitting him back and breaking his jaw and knocking out two of his teeth.

After hearing the evidence on that occasion Judge O Buachalla said it was clear that there are 'certain conflicts' and 'not all witnesses can be telling the full truth'.

He adjourned the case in the hope that 'Mr Carr might see his way to finding €1,000 compensation in respect of the damage caused to the jaw'.

Nigel Allen, for Carr, told Judge O Buachalla last Tuesday that his client had the €1,000 for Gavin, who was also present in court, represented by Colette Culleton.

'Both parties are reconciled to a certain extent,' said Mr Allen. Ms Culleton agreed and Mr Allen said that both parties were willing to withdraw their respective complaint assaults.

Mr Allen said both young men were effectively starting out in life and Carr has been working in Australia and the UK.

Ms Culleton said Gavin has been hoping to go to Australia since this incident occurred in 2008.

Accepting the arguments of both sides on the reconciliation, Judge O Buachalla struck out the charges against Carr and Gavin, but gave the Gardaí liberty to re-enter them if they have any concerns.
