Retired nurse awarded ¤15,000 after fall on path
A RETIRED nurse who suffered injuries as the result of a fall on a footpath brought a civil action against Wexford County Council before Judge Margaret Heneghan at Wexford Circuit Civil Court last week.
Seventy-eight-yearold Breda Nolan, of 1 Rosemary Heights, Ferns, brought her action against Wexford County Council for personal injuries caused by negligence and breach of duty by the defendants at or near the public graveyard in Ferns on March 14, 2006.
Ms. Breda Nolan told the court that she was returning from her sister's, where she had gone for a cup of tea, when the fall occurred as she was
along
the walking footpath.
Judge Heneghan said that it was the support that was lacking and nothing to do with wear and tear.
The plaintiff received injuries to her back and gave evidence she is still suffering.
She awarded Breda Nolan € 15,000 with costs.
