A MURRINTOWN motorist has successfully defended himself against a prosecution brought by Garda Annette Healy.

Accused Philip McDermott from Hayestown Little was summonsed for allegedly driving without due consideration at Oylegate on January 18. He came to the courthouse ready to quote the Road Traffic Act of 2002 as amended in 2006. His reading was that he should have had the option of taking penalty points and a fine by way of fixed penalty notice. Instead, he received no such fine in the post and the matter went instead straight to summons. Inspector Pat Cody acknowledged that McDermott was correct and Judge Donnchadh Ó Buachalla struck out the proceedings.
