Failed to comply with planning

THE DEVELOPERS of a Blackwater housing estate have been fined a total of €1,400 for failing to comply with planning enforcement notices of Wexford County Council. The company, Juice Developments Ltd, have also been ordered by Judge Donnchadh O Buachalla to pay €2,231 in expenses along with legal costs of €800.

The company have been given six months to now fully comply with the enforcement notices of Wexford County Council.

Juice Developments Ltd., who have an address at Monarrig, Blackwater are charged with failing to comply with planning in respect of a development of houses at Ballyheige, Ardcolm. The enforcement notice was served on October 20, 2006.

The main problem, the court heard, related to a drainage and ' ponding' issue, which had been greatly solved when old drains in the area had been opened up.

The court was also told that the developers had obtained planning permission to fix the problem, which involved a development through a neighbour's land, but as late as last week had unearthed another possible solution which would be more cost effective and more appealing to the neighbouring land owner.
