Judge puts stay on commital to prison
A DISPUTE over windows resulted in a committal order for seven days in prison against Seán Redmond (trading as Clonroche Aluminium Company) after creditor Margaret Cullen of Ballyeden, Davidstown made her case at Enniscorthy District Court. However, the order may not be enforced until July 1.
Ms. Cullen said that, at a previous sitting, she was given an instalment order for €600 monthly but nothing had been received, putting Redmond €6,600 in arrears. Appearing for the creditor, solicitor Peter Crean said the money was owed on foot of a Circuit Court judgement. The case dates back as far as the year 2002. He felt that the debtor had used each and every opportunity to avoid the court proceedings and no steps had been taken to clear the debt.
On behalf of the absent man, solicitor Caitriona Walsh said her client had been hospitalised on a number of occasions. Judge Donnchadh Ó Buachalla made out the committal order for the week in jail, with a stay until July 1.
