A MAN was fined €1,250 and banned for two years at Wexford District Court on a drink driving charge. Thomas Pierce, Tullybards, Bridgetown was convicted of drink driving at Ballask, Kilmore on May 21, 2011.
During the case, Dorothy Donovan, B.L. for the defendant contested the validity of his arrest which was made after gardai said he was observed driving erratically.
The defendant admitted in court that he had been drinking but strongly disputed that there was anything wrong with his driving.
He subsequently gave a breath sample which showed a concentration of 53 mcg of alcohol per 100 ml of breath. Ms. Donovan submitted that there was a problem with the garda opinion validating the arrest.
However Judge Gerard Haughton said all that was required for a valid arrest was a bone fide opinion. Pierce was fined €1,250 and banned for two years
