'Shebeen' man goes to High Court

A BALLYCULLANE MAN, charged in relation to the alleged operation of a ' Shebeen' in Saltmills, has had one of his bail terms lifted following a recent application to the High Court.

John Murphy from Ballytarsna, Ballycullane, is charged with failing to comply with the requirements of a closure notice served on him, under the Fire Services Act, and occupying an unlicensed drinking premises, contrary to the Intoxicating Liquor Act, at Tallaght, Saltmills, on July 4, 2010.

An application was made to the High Court for a variation in the bail conditions imposed on Murphy.

Following the hearing before Mr. Justice de Valera, the condition that the defendant would allow the Gardai to gain access to his property at any time between 8 p.m. and 2 a.m. on Friday, Saturday and Sunday upon notification was removed.

All other terms of the bail are to stand and any other application to vary the terms of bail are to be made in the first instance to a judge of the District Court.
